Bankruptcy vs. Debt Consolidation – I receive calls almost daily from potential clients who ask why bankruptcy is a better option than debt consolidation, usually after having just watched one of the many television advertisements regarding the benefits of debt consolidation. However, what the debt consolidation commercials fail to mention is that they have no legal authority to force your creditors to take anything less than what they are owed. In fact, most debt consolidators take your money every month with the mere hope that they can convince your creditors to accept a lesser amount. Many creditors have no interest in settling your debt for a lesser amount and will not agree to any consolidation plan. Further, the creditors have every right to sue you and attempt to collect the money owed through wage garnishment and/or a bank levy, even while a debt consolidator is attempting to consolidate a debt.

Bankruptcy is the better option because the Bankruptcy Code doesn’t give creditors an option. The Bankruptcy Code provides for an immediate and automatic stay, which is essentially an injunction that will stop most creditor actions. The automatic stay will stop pending lawsuits, wage garnishments and bank levies. An experienced bankruptcy attorney can help guide you through this process and help you protect your home, your assets and your well-being.

Call Dudley and Smith, P.A. at (651) 291-1717 today and ask to speak with Brian M. Glodosky or Steven C. Opheim to discuss bankruptcy options that may be available to you.
