st paul attorneysSt.Paul Juvenile Criminal Defense Lawyers

When a juvenile is accused of criminal activity, the first thing that comes to mind for the accused and their family is what impact will the charges have on their future?  Will the juvenile be able to get a job, participate in sports, or get into college?  If convicted, will the record follow the juvenile for the remainder of their life?

To prevent or mitigate the harm to an arrested juvenile’s future, it is crucial to act quickly after the arrest to ensure that their rights are protected and preserved.  The juvenile criminal defense attorneys at Dudley and Smith, P.A. can help you answer these previous questions while guiding you through the criminal defense process.

A juvenile is defined under Minnesota Statutes as a person between the ages of 10 and 17.  In most cases, the law and potential punishment is different for a juvenile than an adult.  For some offenses, a juvenile can be charged and tried as an adult, which carries with it more severe punishment under the law.

Contact our St Paul Juvenile Law Attorneys today for the following offense:

  • Underage DUI
  • Shoplifting
  • Terroristic threats
  • Minor consumption
  • Juvenile drug offenses
  • Juvenile violent offenses

St.Paul Attorneys

st paul attorneysSt.Paul Bankruptcy Attorney

Debt can be overwhelming.  It can cause you physical and emotional stress and impact all aspects of your life, from your career to your family situation.  If you are struggling with overwhelming debt and looking for a way to stop the creditors, speaking to a specialist Minnesota bankruptcy attorney can help you put the pieces back together and determine your best plan of action.  We are a debt relief agency and the bankruptcy attorneys at Dudley and Smith, P.A. provide legal counseling to individuals and businesses in all stages of bankruptcy.  We have represented individuals and businesses who have filed bankruptcy for over 27 years and have successfully handled thousands of cases.

What is Bankruptcy?

Bankruptcy, in general, alleviates you of certain debts.  These debts may include credit card bills, utility expenses, and medical expenses.  Once you file for bankruptcy, your creditors and debt collectors must stop taking action to collect a debt.  Mortgage foreclosure, wage garnishment, and repossession actions may also be stopped by filing bankruptcy.

Although there have been changes to the bankruptcy laws over the years, bankruptcy remains a powerful remedy against your creditors.  Bankruptcy can be a way for you to get a fresh start, to save your home, and to prevent your wages from being garnished or your property repossessed.  It can make a positive difference in your life.

Bankruptcy comes in three forms:

Understanding your Options

Bankruptcy is not for everyone, and it is important that you understand your other options as well.  You may be better off consolidating your debts or taking out a loan to help with your debts.  You may be better off relying on family members for assistance and restructuring your spending habits to help clear those unpaid bills.  When you meet with our Minnesota bankruptcy lawyers, we will help outline your options and determine whether bankruptcy is right for you.  Dudley and Smith, P.A. also has debt collection attorneys who can aid in reducing and settling your debts that led you to consider filing for bankruptcy.

Questions Surrounding Bankruptcy

There are a number of questions surrounding bankruptcy.  Will you lose your home and your car?  Will your credit be affected?  Will you be able to get a loan again?  Will your personal finances be impacted by business bankruptcy?  Can you keep some assets?  The answers to these questions depend on your individual situation.  Speaking to an attorney can give you a better idea of what to expect.  We help people file for relief under the Bankruptcy Code.

St.Paul Attorneys

st paul attorneysSt.Paul Probate & Wills Attorneys

What is Probate? When you or a loved one passes away, his or her estate—money, real estate, and personal property left behind—goes through a court-managed process called probate.  Probate is a process in which the court determines how the deceased’s estate is distributed to heirs and next of kin.  Probate occurs regardless of whether the deceased had a will or not.

Non-Probate Assets

Not every asset has to go through the probate process.  The following assets pass on to named beneficiaries without the need for probate:

  • Property owned as “joint tenants with right of survivorship.” This property passes to the other co-owners by law.
  • Retirement accounts such as IRA and 401(k) accounts
  • Life insurance policies
  • Payable on Death (POD) bank accounts
  • Property held in trusts

Probate Process

Every estate is unique, but the probate process generally follows these steps:

  • File a petition with the proper court to probate the deceased’s estate
  • Notice to heirs in the will or to statutory heirs if there is no will
  • File a petition to appoint an Executor of the will or an Administrator of the estate if there is no will
  • The Executor/Administrator takes control of the estate
  • An inventory and appraisal of all the estate assets is taken
  • Any debts owed by the deceased are paid to rightful creditors from the estate
  • The Executor/Administrator sells estate assets not already distributed by the will or by statute
  • Any applicable estate taxes are paid
  • All remaining assets are distributed to the heirs

Probate Disputes

The death of a family member can create a lot of stress and confusion.  Emotions are running high and disputes may arise over even the slightest of details.  This can lead to drawn-out lawsuits and multiple court hearings during what is called a “will contest.”  Dudley and Smith, P.A. has experienced attorneys who will help you navigate the probate process and protect your rights if a dispute should arise, helping you avoid litigation while saving time and money.
